GOVERNING RULES –RESPONSIBILITY

Travel Agreements shall be governed by the law n° 1084 – 27/12/1977 as ratification and enforcement of the international Covenant Pertinent to the travel agreement (CCV), signed in Bruxelles on 23/04/1970 and with effects from 14/10/1995; By the D. LGT – 17/03/1995 n° 111 applying the EEC directive 314/90.
Euroclub shall be responsible, as travel organiser, to the passengers and to their belongings, according to the above laws and cannot, exceed the limits by them foreseen.

Euroclub informs that all information and prices of the packages and tours on this brochure are subject to availability and are subject to change without any notice. Euroclub shall be responsible to the passengers for supplying the services and accommodations described in this brochure, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind of nature beyond the control of the operator. In such circumstances, the operator will do its best to supply comparable services or accommodations and shall be non refund in this connection.

BOOKING ARRANGEMENTS

People effecting the booking shall be deemed to have accepted the booking conditions.
Euroclub shall accept bookings till the exhaustion of available places. Booking are valid only if participants immediately send the required deposit

CONDITION FOR PAYMENT

The payments to Euroclub shall be made by bank transfer to: Banca di Credito Popolare IBAN IT48 P051 4240 0501 2957 0012 031
Swift code (BIC) BCPTITNN.
Bookings are held valid only when confirmation is immediately followed up by sending a deposit to Euroclub Viaggi for 25% of the total price of the stay. The remainder is to be paid thirty days prior to arrival and must be made by swift bank payment. A fax copy of the bank receipt must be forwarded to Euroclub Viaggi for their information.
For booking confirmed within 30 days prior the arrival, a settlement of the total price of the stay is required. Euroclub reserves the right to cancel the reservation and impose cancellation charges should payments not be received within the above specified period. Euroclub will not be responsible for lost reservations.

INSURANCE

Renunciations and Cancellations.
In case of withdrawal from the agreement, Euroclub shall apply the following penalties, in addition to the charges and costs for the cancellation of service:

  1. 25% of the total price if cancellation arrive till 30 days prior to commencement of services;
  2. 50% of the total price if cancellation arrive till 14 days prior to commencement of services;
  3. 75% of the total price if cancellation arrive till 03 days prior to commencement of services;
  4. No refunds after these terms.

In case of interruption of the stay, Euroclub shall not refund any money, unless passengers can show a declaration of the hotel direction granting a reimbursement. These proceedings are expressly required by Euroclub who will reimburse only the amount that the hotel approves, except expenses met by the agency.

Withdrawal Without Penalties.
Passengers have the right to withdraw from the contract without penalties in the following cases:

  1. Increase of the booked package exceeding 10%.
  2. Fundamental changes of the agreement, required by Euroclub after signing the agreement.

Passengers have anyway to notify to Euroclub in writing their decision to accept or to withdraw within 02 working days. In case of withdrawal passengers have the right to the refund of amounts they have already paid or, in alternative, to another equivalent tourism package,

VARIATIONS (CHANGES)

Euroclub reserves the  right to change scheduled hotels and/or localities with ones of a similar standard and location, in accordance with operating requirements or circumstances beyond its control. If alternatives are not accepted by participants, cancellations are to be sent in writing to Euroclub within 02 (two) working days from the proposal of variation.
Euroclub’s only the amount it has received and it will be under no further obligation or liability.

COMPLAINTS PROCEDURE

Should you have a complaint in respect of your holiday and after returning home you wish to inquire about any services provided, please ensure that all correspondence related to those services is received by Euroclub, by registered letter, within 10 (ten) working days of the tour completion date. This will enable Euroclub to make a timely investigation.
Since the brochure is printed much earlier than the actual services, Euroclub is not responsible for any changes of collateral services which occurred in the meantime. Above all sport and recreative facilities such as pools, discos, markets, animation, miniclub, sport classes or similar could not be activated in case of bad weather conditions or low number of guests.
No refund can be required for this non-activation.

DUTIES OF PARTICIPANTS

All passengers require passport or another valid document and are responsible for obtaining and payment for all visas and entry documents and for meeting all health and another requirements and any documents required by laws, regulations, orders and/or requirements of the countries to be visited.
Moreover passengers have to observe all the rules of caution and diligence, all the information provided by the agency, besides the regulations and administrative directions or laws pertinent with the vacation,
It is passengers responsibility to comply with the terms, conditions, or requirements of any service provider or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of passengers not complying with them.
So passengers require to respond of all damages endured by the tour organiser for their defaults.

BAGGAGE

All baggage and personal belongings are at all times and in all circumstances at the risk of the participants. The organiser shall not be responsible in any cases for possible losses or damages.

RATES

All the rates include vat and taxes.
In case vat increases, rates shall be adapted.
Rates do not include drinks, extras, tips, entrance fees.

ARBITRATION

Any controversy and/or objection shall be placed before the court of arbitration of Naples in compliance with the rules of that court which shall make a final decision binding the parties.
